It's important to understand that whoever leaked word of Spitzer's tryst to the New York Times broke the law because it's against the law to reveal information on an ongoing criminal investigation. One of the most likely sources is the U.S. Attorney for the Southern District of New York -- Michael J. Garcia.
In March 2003 President Bush appointed Michael J. Garcia as the Assistant Secretary for Immigration and Customs Enforcement (ICE) and he was unanimously confirmed by the Senate in November 2003. Assistant Secretary Garcia led the second largest investigative agency in the Federal Government with over 20,000 employees, including 6,000 investigators, and a budget of more than $4 billion.
